Del. Leads The Way On CBM-Related Stay

Law360, New York (March 18, 2013, 11:48 AM EDT) -- As intellectual property practitioners are aware, the Smith-Leahy America Invents Act, Pub. L. No. 112-29, 125 Stat. 284 (2011) (to be codified in various sections of 35 U.S.C.), ushered in a host of new rules and laws relating to patents. Under the AIA, a new procedure has been launched that provides for post-grant review of certain patents claiming subject matter referred to as “covered business methods” or “CBM.”
