11th Circ. Scraps Nielsen Ratings Monopoly Suit

Law360, New York (March 4, 2013, 8:08 PM EST) -- The Eleventh Circuit ruled Monday that a Florida television station operator did not have standing to sue Nielsen Media Research Inc. for abusing its monopoly over the television ratings market because it couldn't point to any rivals that were poised to challenge the ratings giant.

A three-judge panel affirmed the summary judgment Nielsen had won on antitrust claims brought by Sunbeam Television Corp. over the company's decision to change the way it calculated television viewership.
