EPA Takes Heat For “Hot Spot” Analyses

Law360, New York (December 12, 2007, 12:00 AM EST) -- A circuit court judge on Tuesday ordered the Environmental Protection Agency to reverse gears and remand part of its Final Rules for regulating pollution “hot spots” around highways, finding that the agency's decision to ignore part of the Clean Air Act was “arbitrary and capricious.”
