Texas Lawmaker Aims To Curb Vexatious Litigants

Law360, Houston (March 13, 2013, 6:31 PM EDT) -- A Texas lawmaker on Friday filed legislation that would give trial courts more power to dispose of frivolous lawsuits and refine existing procedures aimed at preventing repeat litigants who represent themselves in court from abusing the judicial system.

S.B. 1630, authored by Sen. Royce West, D-Dallas, would allow most trial courts to determine, on their own initiative, that a repeat litigant unrepresented by counsel is “vexatious” and force him or her to post a bond in order to proceed with a civil lawsuit. The bill also...
