Mining Co. Asarco's $80M CERCLA Contribution Suit Paused

Law360, New York (March 12, 2013, 1:42 PM EDT) -- A Missouri federal judge on Monday halted Asarco LLC’s $80 million environmental cleanup contribution lawsuit over the bankrupt mining company’s objections, saying he could not rule on how much the defendants might owe until the total cost of cleanup is determined.

U.S. District Judge John A. Ross stayed proceedings on damages in the dispute, denying a barrage of pending dismissal motions brought by the defendants as premature. He said it would be more efficient to wait until the government reached a final determination on the costs...
