Seneca Says Pa. DEP Improperly Classified Gas Facilities

Law360, New York (March 12, 2013, 2:27 PM EDT) -- Natural gas producer Seneca Resources Corp. on Monday accused the Pennsylvania Department of Environmental Protection of wrongly classifying two natural gas facilities as a single source of pollution for air emissions purposes, saying they aren't similar enough to be linked.

In January, the DEP issued Seneca a general permit for planned natural gas production facilities in Tionesta County, but the company alleges in an appeal before the state Environmental Hearing Board that the DEP violated state and federal law when it determined that two facilities covered...
