FERC Overstepped With $30M Gas-Trader Fine, DC Circ. Says

Law360, New York (March 15, 2013, 3:54 PM EDT) -- The D.C. Circuit ruled Friday that the Federal Energy Regulatory Commission intruded on the “exclusive jurisdiction” of the U.S. Commodity Futures Trading Commission when it fined a former trader $30 million for allegedly manipulating the natural gas futures market.

The court clarified the powers of the two watchdog agencies in handing a victory to former Amaranth Advisors LLC trader Brian Hunter, who was accused of dumping contracts in an effort to depress natural gas prices on the New York Mercantile Exchange and challenged the fine levied...
