FWS Defeats Enviros' Suit To Expand Sea Turtle Habitat
By Sean McLernon (March 19, 2013, 7:00 PM EDT) -- A Washington federal judge on Tuesday quashed an environmental group's bid to force the U.S. Fish and Wildlife Service to quickly expand the critical habitat of an endangered species of sea turtle to include Puerto Rico's coastline, finding the court had no jurisdiction to review the agency's decision.
U.S. District Judge Colleen Kollar-Kotelly said Congress gave the FWS broad discretion to make critical habitat determinations and chose not to set any measurable standard to evaluate the agency's decisions, rejecting an attempt from the Sierra Club to secure Puerto Rico's northeast ecological corridor as protected territory for the leatherback sea turtle....
