TIG Insurance Must Cover Defense In $26M Cleanup Dispute

Law360, New York (March 20, 2013, 2:48 PM EDT) -- A Pennsylvania federal judge on Tuesday ruled that TIG Insurance Co. was obligated to defend Wiseman Oil Co. Inc. in its dispute with the U.S. Environmental Protection Agency over a Superfund site expected to generate $26 million in remediation expenses.

Judge Joy Flowers Conti rejected arguments by TIG that Wiseman’s suit seeking damages in connection with the cleanup of the Breslube Penn Superfund Site in Coraopolis, Pa., should be denied under a pollution exclusion in the policy.
