Pa. Senate Passes Public Charity Definition Bill

Law360, New York (March 21, 2013, 6:12 PM EDT) -- The Pennsylvania Senate on Wednesday approved a bill that would let legislators create criteria to define the state's public charities, as lawmakers battle a state Supreme Court ruling that narrowed the legislature's tax-exemption test for charities.

If passed, legislation authored by Sen. Mike Brubaker, R-Lancaster, will amend the Pennsylvania Constitution to clarify that the state legislature has the exclusive ability to determine what constitutes a purely public charity within the state.
