DC Circ. Blasts DEA Shipping Ban On Walgreen Facility

Law360, Washington (March 21, 2013, 2:43 PM EDT) -- A D.C. Circuit panel on Thursday slammed the U.S. Drug Enforcement Administration for barring a Walgreen Co. drug distribution facility in Florida from shipping controlled substances, saying the agency's order violated the pharmacy chain's due process rights and didn't prove the facility's actions were an imminent threat to the public.

While the DEA told the panel that Walgreen's Jupiter, Fla., distribution center lacked necessary, systematic controls that could prevent shipments of controlled substances to fill fraudulent prescriptions, the appellate judges said they couldn't see how the...
