FDA Challenges Execution Drug Ban In DC Circ.

Law360, Washington (March 25, 2013, 5:04 PM EDT) -- The U.S. Food and Drug Administration urged the D.C. Circuit on Monday to toss an order that blocks states and others from importing an unapproved anesthetic to use in lethal injection executions, saying the lower court ruling could limit the agency's ability to enforce import standards as it sees fit.

A group of death row prisoners claimed the agency's decision to allow unapproved, foreign sodium thiopental imports could subject them to subpar anesthesia prior to their executions and violates the Food, Drug and Cosmetic Act. But...
