Martek Dodges Antitrust Suit Over Baby Formula Additives

Law360, New York (April 1, 2013, 5:15 PM EDT) -- A Maryland federal judge on Thursday dismissed an antitrust suit against Martek Biosciences Corp. after finding that BNLfood Investment SARL failed to prove Martek had anti-competitive contracts that prevented its Belgian rival from entering the U.S. market for baby-formula additives.

U.S. District Judge William D. Quarles Jr. said it was speculation that BNLfood’s inability to sell its products was connected to the long-term contracts Martek had with U.S. manufacturers, which Martek allegedly secured by offering customers cut-rate prices or threatening steep cost increases.
