EPA Atty's Sexually Explicit Emails Justified Firing: Fed. Circ.

Law360, Los Angeles (April 3, 2013, 7:56 PM EDT) -- The Federal Circuit on Wednesday upheld the dismissal of a U.S. Environmental Protection Agency lawyer who was fired after an investigation unearthed evidence that he worked on his outside law practice on agency time and the presence of sexually explicit emails on his work computer.

In a 12-page per curiam opinion, a three-judge appellate panel found that the arbitrator who affirmed the EPA's decision to terminate William T. Jones' employment with the agency had substantial evidence to support the decision.
