Court Partly Upholds Splenda Packaging Decision

Law360 (January 2, 2008, 12:00 AM EST) -- McNeil Nutritionals LLC, the maker of Splenda, received a mostly sweet decision from an appeals court last Monday that let the company go forward with a trademark infringement lawsuit against rival Heartland Sweeteners LLC.

The court upheld part of a U.S. district court's denial of preliminary injunctive relief against Heartland but sent issues regarding Heartland's Ahold sucrose products back to the district court for further review.
