Samsung Rips Ericsson Defenses In 4G LTE Patent Fight

Law360, New York (April 8, 2013, 7:31 PM EDT) -- Samsung Electronics Co. Ltd. on Friday urged the U.S. International Trade Commission to strike Ericsson Inc.'s inequitable conduct defenses against its 4G LTE patent infringement claims, saying Ericsson's arguments that Samsung committed misdeeds before the U.S. Patent and Trademark Office are too vague.

Samsung said Ericsson failed to plead the specific who, what, when, where and how of the alleged material misrepresentation or omission it committed before the USPTO. Ericsson's inequitable conduct claims are subject to a heightened pleading standard set in the Federal Circuit's 2009...
