Pfizer Loses Lipitor Dispute In Canadian Court

Law360, New York (January 3, 2008, 12:00 AM EST) -- Pfizer Inc. is vowing to appeal after Canada's Federal Court rejected Pfizer Canada's bid to block generics maker Apotex Inc. from marketing a copycat version of the blockbuster cholesterol drug Lipitor before a Pfizer patent expires in 2010.

Justice Robert L. Barnes signed off on a judgment Wednesday dismissing Pfizer's application for an order barring the minister of health from issuing a Notice of Compliance to Apotex before the expiration of Canadian Patent Number 2,021,546.
