Pa. Justices Won't Hear Challenge To Quarry Zoning Law

Law360, Philadelphia (April 11, 2013, 6:23 PM EDT) -- The Pennsylvania Supreme Court said Wednesday that it would not take up an appeal over an ongoing challenge to a Montgomery County township's zoning ordinance requiring companies to obtain a special exception when looking to begin quarrying activity.

In denying the appeal, the justices left standing a Commonwealth Court decision finding that Gibraltar Rock Inc. and Sahara Sand Inc., two companies looking to operate a 300-acre quarry in New Hanover Township, had improperly filed three challenges to a township zoning ordinance they claimed illegally excluded quarrying...
