DC Circ. Won't Kill FTC Bid For Boehringer Deal Docs

Law360, New York (April 12, 2013, 10:47 PM EDT) -- The D.C. Circuit on Friday refused to dismiss the Federal Trade Commission’s bid to force Boehringer Ingelheim Pharmaceuticals Inc. to turn over allegedly privileged documents on patent settlements with Barr Pharmaceuticals Inc., ruling the agency’s appeal was legitimate.

According to the three-judge panel, U.S. Magistrate Judge John M. Facciola’s rulings that Boehringer didn’t have to turn over financial analyses of a co-promotion agreement with Barr as a protected work product, but had to explore its records and turn over other documents requested by the FTC —...
