High Court Won't Tackle Patent Obviousness In Sunglass Suit

Law360, New York (April 15, 2013, 7:32 PM EDT) -- The U.S. Supreme Court on Monday declined to hear Aspex Eyewear Inc.'s appeal of decision that invalidated its patent for magnetically attachable sunglasses, in a case that sought to refine the test to determine patent obviousness.

Without comment, the high court denied Aspex's petition for a writ of certiorari, which the eyewear maker filed in March. The decision leaves in place the Federal Circuit's decision that that a patent Aspex asserted against rival Altair Eyewear Inc. in 2002 was invalid because it had been made obvious...
