Undocumented Workers Are Employees: D.C. Circuit

Law360 (January 4, 2008, 12:00 AM EST) -- A federal appeals court has affirmed that undocumented workers at a kosher meat company are considered employees under federal labor laws.

In a 2-1 ruling, the U.S. Court of Appeals for the District of Columbia ruled that Agri Processor Co. Inc.'s undocumented workers are protected as employees under the National Labor Relations Act and are entitled to representation by the United Food and Commercial Workers union.
