11th Circ. Asks Fla. Justices To Clarify Workers' Comp Limits

Law360, New York (April 15, 2013, 7:52 PM EDT) -- The Eleventh Circuit on Monday asked the Florida Supreme Court to determine whether the family of a landscaping employee killed on the job can collect a $9.5 million judgment from his employer’s insurer, which issued a two-part policy that capped workers’ compensation coverage.

A three-judge panel certified the question to Florida’s high court, saying the issue of standing needed to be settled before it can rule on Leticia Morales’ appeal of a lower court finding that a workers’ compensation exclusion in part 2 of the liability policy...
