Coal Plant Expansion Review Unnecessary, DC Circ. Hears

Law360, Washington (April 16, 2013, 5:45 PM EDT) -- Sunflower Electric Power Corp. urged a D.C. Circuit panel Tuesday to toss an injunction preventing it from seeking approval for a coal-fired power plant expansion without a full environmental impact study, claiming the lower court's ruling would entangle the project in regulatory and legal issues.

A lower Washington federal court remanded the Sierra Club's suit over six Rural Utilities Service approvals for the plant expansion and issued an injunction forcing the U.S. Department of Agriculture to postpone additional decisions until an environmental impact statement was completed....
