UK Antitrust Watchdog Hits GSK With Pay-For-Delay Claims

Law360, Washington (April 19, 2013, 2:14 PM EDT) -- A U.K. antitrust regulator slammed GlaxoSmithKline PLC with an antitrust complaint Friday alleging the pharmaceutical giant entered pay-for-delay deals with three generic-drug makers to preserve its hold on the market for its blockbuster antidepressant Seroxat.

According to the Office of Fair Trading, GSK may have violated U.K. competition laws and abused its "dominant position" in the Seroxat market by making "substantial payments" to Alpharma Ltd., Generics (UK) Ltd. and Norton Healthcare Ltd. in order to keep the generic competition at bay.
