Stryker's New Claims Over XL Settlement Meet Resistance

Law360, New York (April 23, 2013, 5:14 PM EDT) -- A magistrate judge on Monday recommended Stryker Corp. not be allowed to make new consequential damages and bad faith settlement claims against XL Insurance America Inc. in its suit seeking coverage for litigation over its allegedly defective artificial knee, saying the claims aren’t part of the case and never were.

U.S. Magistrate Judge Joseph G. Scoville said Stryker should have brought the new claims in a separate complaint, since neither its original nor its amended complaint against XL touched on them.
