P&G Asks 11th Circ. To Bar Experts In Fixodent Case

Law360, New York (April 29, 2013, 7:30 PM EDT) -- Procter & Gamble Manufacturing Co. urged the Eleventh Circuit on Friday to uphold a lower court order that excluded a consumer's expert testimony in a lawsuit alleging the company's denture cream causes neurological damage, saying the testimony was riddled with flaws.

Plaintiff Marianne Chapman and her husband in January said the district court order violated the standard created by the U.S. Supreme Court's Daubert v. Merrell Dow Pharmaceuticals Inc. decision, which says courts are gatekeepers that must ensure the expert testimony rests on a reliable foundation....
