8th Circ. Finds Coverage For Worker Injury Under Minn. Law

Law360, New York (May 2, 2013, 8:55 PM EDT) -- In a decision that predicts how the Minnesota Supreme Court would rule, a divided Eighth Circuit held Thursday that Harleysville Insurance Co. should cover a workplace injury suit against a trucking company because of contractual obligations that its policyholder took on.

Upholding a lower court ruling, the Eighth Circuit found that Harleysville's policyholder Physical Distribution Services Inc. was contractually required to indemnify trucking company Miller Transporters Inc. in the underlying suit.
