Supreme Court Rebuffs Solicitor General, Takes LabCorp Case

Law360 (October 31, 2005, 12:00 AM EST) -- Despite a recommendation from the Bush administration urging it not to hear the case, the U.S. Supreme Court has decided to consider a patent infringement suit covering technology that predicts heart attacks, strokes, and dementia.

The suit was filed by Competitive Technologies licensee Metabolite Inc. against Laboratory Corporation, alleging LabCorp infringed a CTT patent for homocysteine assays instrumental in predicting the medical conditions.

Last month, the U.S. Solicitor General recommended to the U.S. Supreme Court that LabCorp’s appeal be denied.
