Gender-Specific Tariffs Unconstitutional, Steve Madden Says

Law360, New York (May 7, 2013, 7:53 PM EDT) -- Steve Madden Ltd. and two other shoe-importing companies claimed Tuesday that U.S. customs officials are violating the Equal Protection Clause by assigning different tariff rates to men's and women's shoes.

Steve Madden, Blue Star Imports LP and E.S. Originals Inc. sued U.S. Customs and Border Patrol in the U.S. Court of International Trade, claiming separate footwear tariff rates based on gender or age — like for children's sneakers — amount to an unconstitutional disparate treatment of citizens.
