Fed. Circ. Upholds Classification, Duty Rate For Ugg Boots

Law360, New York (May 8, 2013, 4:41 PM EDT) -- The Federal Circuit ruled Wednesday that the U.S. government correctly assessed duties on Deckers Outdoor Corp.'s popular Ugg boots, rejecting the company's claim that the items were misclassified and should have been subject to lower duties.

The court upheld U.S. Court of International Trade ruling that Ugg boots should be classified as "footwear of the slip-on type," which is subject to duties of 37.5 percent. Deckers argued that the boots should instead be classified as "footwear with outer soles of rubber ... and uppers of textile...
