Ann Taylor Latest To Sue Over Gender-Based Tariffs

Law360, New York (May 9, 2013, 5:44 PM EDT) -- Ann Taylor Inc. on Thursday joined the growing chorus of American companies who claim U.S. customs officials are violating the the U.S. Constitution by assigning different tariff rates to apparel designed for men and women.

The retail chain sued U.S. Customs and Border Patrol in the U.S. Court of International Trade, claiming separate tariff rates based on a customer's gender or age, like women's or children's clothing, amount to an unconstitutional disparate treatment of citizens.
