EPA's Water Pollution Limits Row Won't Get High Court Review

Law360, New York (May 13, 2013, 1:01 PM EDT) -- The U.S. Supreme Court on Monday declined to hear a Massachusetts water control district's challenge to federal phosphorous discharge limits, solidifying a First Circuit decision in favor of the U.S. Environmental Protection Agency and the scientific process it used to set the standards.

The Upper Blackstone Water Pollution Abatement District argued in its petition for writ of certiorari that the EPA didn't fulfill its legal obligation to tailor the limits to site-specific conditions, but the high court decided not to take up the case.
