Fed. Circ. Tosses $31.6M Patent Judgment For Metso Minerals

Law360, Los Angeles (May 16, 2013, 4:30 PM EDT) -- The Federal Circuit on Tuesday threw out a $31.6 million judgment against Terex Corp. and others in a suit that found the companies infringed Metso Minerals Inc. patent for industrial machines known as “screeners” that sort rock and gravel.

The three-judge panel concluded that Metso's patent was obvious as a matter of law, reversing the 2011 judgment that Terex and subsidiary Powerscreen International Distribution Ltd., now known as  Terex GB Ltd., had infringed the patent, which it said was not obvious.
