Wyeth Fails In Bid To Dismiss Prempro Claim

Law360, New York (January 16, 2008, 12:00 AM EST) -- After losing an earlier bid to dismiss failure to warn claims, Wyeth Pharmaceuticals Inc. has suffered another defeat in its quest for summary judgment in a lawsuit alleging the company's hormone replacement drugs Prempro and Premarin cause breast cancer.

On Monday, Judge William Wilson Jr. of the U.S. District Court for the Eastern District of Arkansas batted down Wyeth's request to throw out the design defect claim, choosing to let plaintiff Donna Scroggin's allegations move forward.
