Fla. Airline Asks 11th Circ. To Exempt It From NLRB Probes

Law360, Miami (May 23, 2013, 4:24 PM EDT) -- Florida-based cargo airline Amerijet International Inc. on Thursday asked the Eleventh Circuit to declare that the National Labor Relations Board does not have the jurisdiction to investigate an unfair labor practice charge because the airline falls under the Railway Labor Act.

Amerijet attorney Joan Canney asked the appeals court panel for a determination that the NLRB does not have the authority to begin any other investigations into the airline's employees because they are not governed by the National Labor Relations Act, saying the federal agency knew...
