Fla. Redistricting Foes Can't Depose Pols: Appeals Court

Law360, New York (May 22, 2013, 6:41 PM EDT) -- A Florida appeals court ruled Wednesday that a coalition of nonprofits challenging a congressional reapportionment plan can't depose lawmakers and legislative staff members to determine if they crafted the plan with a discriminatory intent, because the information is protected by a legislative privilege.

The First District Court of Appeal said that although the state constitution doesn't allow intentionally discriminatory redistricting, the constitutional amendment that bans the practice doesn't mention or suggest that lawmakers can be compelled to testify on matters regarding the process.
