FTC Lawsuit Sends Barr Back To Court

Law360, New York (November 8, 2005, 12:00 AM EST) -- Fresh from an appeals court victory regarding an authorized generics deal, Barr Laboratories has been slapped with another lawsuit over the controversial practice, this time facing allegations of unfair competition from the Federal Trade Commission.

The FTC alleges that an agreement between Barr and pharmaceutical holdings company Galen Holdings PLC (now known as Warner Chilcott Holdings Company, Limited) that authorized Barr to produce a generic version of oral contraceptive Ovcon-35 violates federal unfair competition laws.
