FTC Says High Court Case Dooms NC Dental Board Appeal

Law360, New York (May 23, 2013, 8:08 PM EDT) -- The Federal Trade Commission told the Fourth Circuit on Wednesday that a recent U.S. Supreme Court decision urging deference to agencies' interpretations of their own jurisdiction supported its efforts to pursue an antitrust case against North Carolina's dental board.

The competition watchdog pointed to Monday's ruling in City of Arlington v. Federal Communications Commission, a case brought by several local government agencies fighting with the Federal Communications Commission over zoning rules for wireless facilities.
