Canning Asks High Court To Back NLRB Appointment Ruling

Law360, New York (May 23, 2013, 5:27 PM EDT) -- Soda bottler Noel Canning told the U.S. Supreme Court on Thursday that it should uphold the D.C. Circuit's blockbuster ruling that three recess appointments to the National Labor Relations Board were unconstitutional.

Noel Canning said it won't oppose the NLRB's April 25 petition for writ of certiorari, which challenged a Jan. 25 appellate opinion that cast doubt on a slew of previous NLRB decisions as well its ability to rule going forward, because the case raises extremely important constitutional issues.
