Nike Says Clothing Co. Abandoned Rights To 'Fuel' Mark

Law360, New York (May 24, 2013, 2:11 PM EDT) -- Nike Inc. told a South Carolina federal judge Thursday that Fuel Clothing Co. Inc. granted naked licenses for its trademark and thereby abandoned it, urging the court to dismiss Fuel's infringement and false designation of origin suit against the sportswear giant.

Oregon-based Nike said even if the company had not abandoned the "Fuel" mark, its claims should be tossed because there was no probability that consumers would be confused by Nike's use of the mark on T-shirts and in connection with its Nike+ FuelBand, a wristband...
