Vt.'s Historic Fight On 'Patent Trolls' May Fall Flat

Law360, New York (May 29, 2013, 9:08 PM EDT) -- The state of Vermont's aggressive, unprecedented effort to combat the tactics of so-called patent trolls faces significant hurdles, attorneys say, since patent litigation is governed by federal law and states have limited authority to regulate anything associated with patents.

Vermont last week enacted a new law allowing companies to sue patent owners that allege infringement in bad faith. The state's attorney general also sued a patent-holding company alleging it violated consumer protection laws by accusing Vermont businesses of infringement without evidence.
