Atty Dodges Sanctions Over Facebook Post On FCA Mediation

By Brian Mahoney (May 29, 2013, 1:15 PM EDT) -- A Florida federal judge Wednesday said she won't sanction an attorney who posted an update on his Facebook profile related to a $43 million settlement demand in a qui tam False Claims Act suit against a shipyard contractor.

U.S. District Judge Cecilia M. Altonaga declined to sanction New York attorney Derrick Storms for posting a picture of himself and his client, Adrian Batlle of plaintiff A1 Procurement LLC after a mediation session with Tampa-based defendant Hendry Corp.

The picture, which portrayed a smiling Storms, had a caption that said: "Pic After Making $43 Million Dollar Deman[d at] Mediation."
