RI City Prods 1st Circ. To Back Tobacco Sales Restrictions

Law360, New York (May 29, 2013, 7:52 PM EDT) -- The city of Providence, R.I., pushed the First Circuit on Tuesday to affirm a decision upholding two tobacco sales and advertising ordinances under attack by Philip Morris USA Inc. and other tobacco companies, pointing to a Second Circuit decision backing New York City tobacco restrictions.

The companies are challenging ordinances that ban the redemption of coupons or multipack discounts for tobacco products and restrict the sale of flavored tobacco products to smoking bars. A Rhode Island federal judge ruled in favor of the city in December,...
