Walker Industries Inc. and its MI Windows & Doors Inc. subsidiary told the Fourth Circuit on Tuesday that a South Carolina federal court overstepped its authority by tossing a $12.5 million punitive damages verdict against Liberty Mutual Fire Insurance Co. in litigation stemming from allegations of defective windows.
The policyholder appellants argued in their reply brief that the lower court's August ruling, which overturned a jury's bad-faith finding against the insurer, ran contrary to the evidence presented at trial.
