Fed. Circ. OK'd Undisclosed Invention, Fox Tells High Court

Law360, New York (May 31, 2013, 12:14 PM EDT) -- The Fox Group Inc. has urged the U.S. Supreme Court to overturn a Federal Circuit ruling last year that invalidated its semiconductor wafer patent, saying the appeals court gave unprecedented priority to poorly disclosed inventions.

Fox said in a May 21 brief that the November ruling — that Cree had invented and produced a low defect silicon carbide, or SiC, crystal before Fox registered its patent — gave priority to an invention that Cree had concealed, didn’t commercialize and didn’t patent.
