DC Circ. Backs Pa. Mine Safety Violation Ruling

Law360, New York (June 7, 2013, 5:13 PM EDT) -- The D.C. Circuit on Friday upheld a Federal Mine Safety and Health Review Commission ruling that a Pennsylvania coal mine's failure to adequately maintain emergency lifelines in its escapeways violated federal law, saying the violations were “significant and substantial.”

The appellate court dismissed mine operator Cumberland Coal Resources LP's petition for review, rejecting its argument that the commission's decision wasn't supported by substantial evidence.
