DC Circ. Keeps Secret Doc On Free Trade Talks Under Wraps

Law360, Los Angeles (June 7, 2013, 9:55 PM EDT) -- The D.C. Circuit on Friday blocked the release of an oft-sought classified document from talks on the now-stalled Free Trade Area of the Americas agreement, ruling that its release could potentially handicap the U.S. in future negotiations with some foreign governments.

The paper lays out U.S. positions on “most-favored-nation” treatment, which grants investors trade advantages over others. The U.S. Trade Representative's Office pushed the D.C. Circuit to block the release of the document, claiming the courts aren't qualified to second-guess why it's been kept under wraps....
