FTC Asserts Antitrust Authority In Patent Licensing

Law360 (January 23, 2008, 12:00 AM EST) -- In a groundbreaking ruling, the Federal Trade Commission has claimed the authority to enforce against a company that allegedly charged excess licensing royalties for standardized Ethernet patents.

The FTC announced Wednesday it had decided in a 3-2 vote to file a complaint against and accept a settlement with Negotiated Data Solutions LLC for allegedly engaging in an unfair method of competition and an unfair act or practice under Section 5 of the FTC Act.
