Protecting Privileged Information In EU Investigations

Law360, New York (January 23, 2008, 12:00 AM EST) -- Last week, the news media reported that a group of pharmaceutical companies were raided on Jan. 16, 2008 by European Commission (“EC”) investigators as part of a probe initiated to investigate possible anti-competitive practices in the pharmaceutical industry.

The stated purpose of the EC inquiry is to examine whether pharmaceutical companies are forestalling competitors from selling cheaper copies of branded products, or rival new medicines, in order to protect profits for their own branded products.
