DC Circ. Axes NRG Challenge To FERC Power Settlement

Law360, New York (June 14, 2013, 3:49 PM EDT) -- The D.C. Circuit squashed NRG Power Marketing LLC's challenge against the Federal Energy Regulatory Commission's approval of a transmission service settlement NRG claims gives Consolidated Edison Co. of New York Inc. rights that competitors don't have, saying Friday that FERC's decision was supported by substantial evidence.

NRG argued that the settlement, which authorized rollover agreements that ConEd inked with PJM Interconnection LLC violated FERC's open access transmission policies, but the circuit court said that while the agreement didn't conform with an applicable open access transmission tariff,...
